The right to unilaterally terminate the Agreement

Only customers who are consumers have the right to unilaterally terminate the contract.

Unilateral termination

1. In order the customer could gain his right to a unilateral termination of the Contract, the customer has to inform Gigimigi of his decision on unilateral termination of the Contract before the expiration and with an unequivocal statement sent to the post mail (GIGIMIGI d.o.o., Remetnjak 12, Mavrinci, 51219 Čavle, Hrvatska), or by an email to info@gigimigi.eu, in which he states his name and surname, address, phone number or email, whereas he can use stated written Form for unilateral termination of the Contract.
2. Also, Form for unilateral termination of the Agreement. can be filled in electronically by the user / buyer and in which case Gigimigi will without delay send him a confirmation of receipt of the notice of unilateral termination of the Agreement by e-mail.
3. The deadline for unilateral termination of the Contract is 14 (fourteen) days from the day when the buyer or a third party designated by the buyer, other than the carrier, the goods subject to the Contract are handed over, or in case of service, from the conclusion of the Contract.

Consequences of unilateral termination

If the Customer unilaterally terminates the Agreement, he will be refunded the funds received from him, without delay, and no later than 14 (fourteen) days when Gigimigi or info@gigimigi.eu  online store receives the user's decision to unilaterally terminate the Agreement. The refund will be made to the IBAN account specified by the user in the unilateral termination of the Agreement. Gigimigi may return the money only after the goods have been returned to him or after proof has been provided that the goods have been sent back.

The buyer is obliged to hand over the goods or send them to the address GIGIMIGI d.o.o., Remetnjak 12, Mavrinci, 51219 Čavle, Croatia, without undue delay, and in any case no later than 14 (fourteen) days from the day when he sent Gigimigi his decision on unilateral termination of the Agreement. The direct costs of returning the goods are borne by the buyer.

Prior to the termination of the Contract, the Buyer is requested to call the telephone number +385 91 984 5679 or contact info@gigimigi.eu in order to be explained the procedure for returning the goods.

The buyer is responsible for any impairment of the goods resulting from the handling of the goods, other than that which was necessary to determine the nature, characteristics and functionality of the goods.

When returning the goods, the buyer is obliged to submit the accompanying documentation and the submitted warranty certificate that was attached to it, otherwise, Gigimigi is not obliged to return the paid price. 

If, at the request of the user, the performance of the service started during the unilateral termination period, the buyer is obliged to pay Gigimigi an amount proportional to what was delivered by the time the user notified Gigimigi of the unilateral termination.

The buyer has no right to unilaterally terminate the contract

• if the service has been fully performed and the performance has started with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilateral termination of the Contract if the service is fully performed,
• if the subject of the Contract is goods which, by their nature, are inseparably mixed with other things after delivery,
• in the case of a purchase referred to in Article 72 of the Consumer Protection Act, and in accordance with Article 79, item 4 and item 12 of the Consumer Protection Act.
