General Terms and Conditions for Online Shop

We are the company GIGIMIGI d.o.o., Remetnjak 12, Mavrinci, 51219 Čavle, Croatia (hereinafter "Gigimigi"). You can contact us at phone +385 91 984 5679 from Monday to Friday from 08:00 to 16:00 as well as by e-mail info@gigimigi.eu. Radno vrijeme internetske trgovine www.gigimigi.eu je od 0-24 h.

We do not use gender-sensitive language in the text for better readability and comprehensibility.

Gigimigi online shop, contract content, all other information, Gigimigi customer service, data and complaint processing are available in Croatian and English.

Purchases in the Gigimigi online shop are only possible for people over 18 years of age.

Please read these General Terms and Conditions for the Gigimigi online shop and the website www.gigimigi.eu carefully (hereinafter: the Terms).

Only these business Terms in the version valid at the time of ordering apply to your orders in our Gigimigi online shop on Gigimigi.eu. Terms of business that are contrary, deviating or additional to the following provisions do not apply, unless their written consent is given.

Gigimigi is authorized, without prior notice, to change the content of these Terms, product range, prices, other information related to Gigimigi online shop and all other content www.Gigimigi.eu, which is why users are obliged every time they visit the website www.Gigimigi.eu to review the content of the same, and the Terms in particular. Doing the opposite relieves Gigimigi of any responsibility.

By using the Gigimigi online shop service and all associated sites and services on www.Gigimigi.eu, it is considered that consumers are familiar with the Terms at all times and that they fully understand and accept them.

These Terms and Conditions apply to the rights and obligations related to the purchase of products through the Gigimigi online shop and the rights and obligations arising from the conclusion of the Distance Selling Agreement (hereinafter: the Agreement) between consumers as end customers and retailers, are considered an integral part of such contracts.

If you do not agree with the Terms, then do not use the website www.Gigimigi.eu for the purpose of purchasing products or obtaining information about them.

We instruct users to familiarize themselves with these Terms before each purchase and to check them regularly, in order to be aware of all their rights and obligations, as we reserve the right to change them at any time if we deem it necessary.

  3. customer: any person who has ordered a product after reviewing and selecting a product.
  4. user of www.Gigimigi.eu: any person who uses the website www.Gigimigi.eu for the purpose of purchasing products advertised on the same or obtaining information about a particular product
  5. use of www.Gigimigi.eu: access to the site www.Gigimigi.eu in order to obtain information about its contents and / or make a purchase on the Gigimigi online shop
  6. online purchase or purchase through Gigimigi online shop: purchase of products through www.Gigimigi.eu
  7. products: all products featured on www.Gigimigi.eu, which can be purchased through the Gigimigi online shop
  8. consumer: any person who is a customer, buys products or uses the website www.Gigimigi.eu outside their trade, business, craft or professional activities
  9. registered customer: a customer who has a ‘My Account’ and thus realizes any benefits
  10. customer-guest: a customer who does not have an ‘My Account’ can also make purchases.

Your order - concluding a contract

Our offers are not binding. We reserve the right to make reasonable technical and other changes. Your order at www.Gigimigi.eu represents an offer to Gigimigi to conclude a sales contract. 

Acceptance of the offer is done by sending a confirmation of the order to the e-mail address you entered. 

Sales take place only to adults, i.e. persons who have reached 18 years of age. By accepting the Terms, you acknowledge that you have entered accurate information about your age.

You can add all items marked as "deliverable" to the cart by clicking the "Add to Basket" button in the cart icon or by clicking "Buy". As soon as you decide to buy, by clicking on the "Pay" or "Pay Now" button in the cart, you begin the ordering process through one of two possible options: 

You can make a purchase as a registered customer by opening your ‘My Account’ (hereinafter: ‘My Account’) to make your next orders easier. You can find more information in the 'My Account' Terms and Conditions and in Privacy PolicyTo open your ‘My Account’, among other things you must provide your name, email address and password. The password must be treated confidentially and must not be passed on to third parties.

Purchase can be made as a guest buyer without registering "My Account". 

You can only benefit from the purchase and delivery if you make the purchase as a registered customer. 

Click the "Order" button to complete your order. This way you submit a binding offer to buy the goods in your cart. Before that, you can inspect the goods and change them in the basket. From this point on, it is not possible to change the order or data. In case you want to change your order or information, please contact our customer service as soon as possible. 

By clicking on the "Order" button, you also accept these Terms and confirm that you are familiar with Privacy Policy as well as the right to unilaterally terminate the contract to which these Terms apply. 

After you submit your order, we will automatically notify you via email that we have received your order. Confirmation of receipt of the order that Gigimigi automatically sends by e-mail does not constitute binding acceptance of your offer. The contract is concluded when Gigimigi confirms the order of goods by a separate e-mail and delivers its Terms and Conditions valid at the time of purchase or confirms delivery (pick-up e-mail). You will receive this confirmation by e-mail within three working days when choosing delivery to the desired address. If you have not received an order confirmation or delivery notification within the above deadlines, you no longer have any obligations regarding the order, unless we inform you via www.gigimigi.eu that a delay is possible due to the increased volume of orders.

In the event that from the moment of receiving the order to the moment of sending the e-mail of accepting the order, a product becomes undeliverable in the ordered quantity or it's no longer available at all, Gigimigi reserves the right not to notify the customer, but all available quantities and products will be shipped.

The main characteristics of the product, method of use and price refer to those that are valid at the time of concluding the order and will be indicated with each product, and the method of payment and method of delivery will be listed on www.Gigimigi.eu. valid at the time of concluding the order.

All information on the purchase confirmation based on the order in the Gigimigi online shop will be delivered to the e-mail address provided by the customer in the ordering process or in the shopping basket during entering data when concluding the order. All prices are expressed in Croatian Kuna (HRK). Prices do not include VAT because the taxpayer is not in the VAT system, VAT is not calculated on the basis of Art. 90 paragraph 1 and paragraph 2 of the VAT Act (Official Gazette No. 73/13). For foreign buyers, the price is converted into the average value of the exchange rate for the Euro in accordance with the exchange rate list of the Croatian National Bank on the day of purchase.

The seller may, in accordance with the Consumer Protection Act, determine special conditions of sale or special forms of sale, which will be clearly indicated on www.Gigimigi.eu

If the customer does not receive the order confirmation notification, there is a possibility that he entered his e-mail address incorrectly. In that case, we ask the customer to contact us via e-mail / phone / Contact Form, which you can find here so that our customer service can check whether the order has been received. Minimum order value

When ordering on www.gigimigi.eu, there is no minimum order value, and the maximum order value is HRK 10,000.00.    

For technical reasons, Gigimigi reserves the right to limit the purchase quantity of certain products. In the event that the ordered quantity of products is not available at the time of shipment of the ordered shipment, Gigimigi will not provide special notice to the customer but will deliver the available quantities and products from the order.

Delivery, availability of goods

Delivery is made in the Republic of Croatia and other countries of the world.

If you provide a third party address, you must first obtain consent from the third party to forward the data to Gigimigi.

The cost of delivery is calculated automatically when you buy the product and you are issued an invoice with the price of the purchased products and the delivery price.

 The cost of delivery will be shown in the cart with the price of the product. Worldwide shipping costs are FREE.

We provide the following types of delivery:

 Standard delivery to the end customer via DHL and GLS.

The customer confirms the receipt of the order with his signature.

The standard order processing time is 2 to 3 working days (Monday to Friday, except holidays).

Delivery time is about 7 working days. The time limit within which the order will be delivered depends on the current terms and conditions of the delivery service provider.

Due to the coverage of the delivery area by the service provider, delivery to certain locations - in accordance with the provisions of the delivery service provider - is not possible, so we ask you to consider delivery to the islands and in certain parts of Croatia and World on courier's web address.

For the following payment methods, the delivery deadline starts on the day of concluding the contract:

a. Credit card and debit card (Mastercard®, Maestro®, VISA, Diners)

The delivery deadline expires at the end of the last day of the specified delivery deadline. If the last day falls on a Saturday, Sunday or public holiday at the place of delivery, the last day of the delivery period becomes the next working day. In case of delayed delivery, we will notify you without delay.

If it is not our fault that we cannot deliver the ordered goods because one of the suppliers is not fulfilling its contractual obligations, Gigimigi has the right to cancel the sale to the buyer.

In the event of a change in the delivery time or any other important circumstances for the execution of the order, the customer will be notified immediately by our Gigimigi customer service by e-mail or telephone.

Gigimigi is entitled to partial delivery to the address specified when ordering. Additional delivery costs are borne by Gigimigi.

Shipping of order take place at the risk of Gigimigi. The risk of losing or damaging the delivered items will not be transferred to you until the delivery person delivers the goods to you or the third party you have specified. If Gigimigi has unfulfilled partial services or unfulfilled partial services are not possible, you have the right to withdraw from the contract in respect of undelivered goods. Payments already made in favor of Gigimigi in this case must be reimbursed proportionately.

Prices and delivery costs

All prices include the legal value added tax valid at the time of concluding the order. They may differ from the prices charged at the same time in our stores in cases where special forms of sales are carried out either only at the Gigimigi online shop or only at points of sale. The relevant price is stated at the time of concluding the order.

For standard delivery to the customer's address, the delivery cost is FREE.

The return of the package is at the expense of the customer. The original invoice must be attached. If you do not have an account, please contact customer service who will provide you with a refund form. In case of cash payment, it is necessary to submit the IBAN to which you want the refund to be made.

Methods of payment and delivery of invoices

Gigimigi offers the following payment methods:

  • Credit card (Mastercard, Diners, VISA)
  • Debit card (Maestro)

With each order, we reserve the right not to offer certain types of payments and to refer to other types of payments.

a) Peculiarities of credit and debit card payment methods

Credit and debit card payments are made through our payment service provider in accordance with applicable security standards. VISA Secure and Mastercard® Identity Check ™ make credit card payments particularly secure thanks to special authorization procedures. To successfully complete your order, please follow the instructions.

Furthermore, we are entitled to the necessary costs of appropriate out-of-court collection measures in a reasonable amount. If an order is issued to a collection agency or a lawyer, the costs will be calculated in accordance with the applicable tariffs. If it is necessary to check the address, it is necessary to reimburse the resulting costs.

The delivered goods remain the property of Gigimigi until full payment.

The buyer is obliged, under the threat of losing the right to a subsequent complaint, to check the delivered shipment with the issued invoice and in case of disagreement they immediately state it to the delivery service. Subsequent complaints will not be accepted.

Only electronic invoice / electronic approval is issued.

In some cases, and / or when requested by the customer, a paper invoice may be issued and delivered together with the order.

The invoice is sent by e-mail or together with the delivery of the order.

Guarantees

All goods that in accordance with the regulations must be equipped with supporting documents and warranty will be delivered to the buyer with the attached supporting documents and warranty. 

Warranty, technical instructions, assembly instructions and instructions for use are included with the product, and the customer in terms of Article 42 paragraph 6 of the Consumer Protection Act in a clear and understandable manner is informed in advance about the data related to the product as well as the existence of services offered after the sale.

In case of need for service, please check the documentation on authorized service provided with the device and follow the instructions of authorized service, and if the product malfunctions within the warranty period, the customer is authorized to contact authorized service directly in accordance with instructions on warranty list.

Gigimigi does not warrant that photographs of the product will fully match the appearance of the product itself. We are not responsible for possible unintentional errors in the product description. Although all descriptions are checked regularly and in detail, differences between the actual product and the product photo and the product described on this site are possible if the manufacturer changes any of the characteristics or content of the product. 

Although all product information listed on the product page and although we have taken all reasonable measures and made every effort to ensure the accuracy and timeliness of all information, before use or consumption, always read the notice on the product or instructions for use as there is a possibility of differences in the above data due to frequent changes. This is published solely for the purposes of Gigimigi and may not be reproduced in any way without Gigimigi's prior written consent.

The site contains materials protected by copyright, registered trademark, and / or protected design and other information covered by other third party rights, including but not limited to texts, software, photographs, videos, graphics, music, sound, as well as the entire content of the site, therefore it is expressly prohibited without special permission any copying, distribution, transfer, publication, linking, deep linking or otherwise modifying the content of the website, and redistribution, retransmission, publication or commercial use of downloaded material without express written permission of Gigimigi or copyright holder. 

The user agrees not to hold Gigimigi liable and to waive all claims for damages and costs, including legal representation costs, that may arise from the use of this site by the user.

Gigimigi is released from any liability for damage that may occur to devices that allow access to the Gigimigi online shop and data stored on the same devices when using the site if it was caused by illegal actions of third parties, computer viruses and the like and other cases for which Gigimigi is not responsible. Also, Gigimigi is released from any liability in the event of circumstances that prevent the use of Gigimigi online shop or online sales. 

When purchasing any product that is subject to copyright or intellectual property rights, Gigimigi does not grant any additional rights of use and publication, except as expressly granted or licensed by the manufacturer / distributor of the product.

When Gigimigi provides appropriate links to visit other people's sites, they are not owned by Gigimigi and these Terms in the case of using the subject pages do not apply to Gigimigi and the user / customer. Gigimigi does not control this website and assumes no responsibility for any of them or their content. Visiting these sites is entirely at the user's / customer's own risk and Gigimigi assumes no responsibility.

Responsibility

The ordered products are packed in such a way that they are not damaged by the usual handling in transport / delivery. 

In cases when the product delivered to the customer is different from the one he bought, he has the right to repair, and if that is not possible, he has the right to delivery of the ordered product, and a refund in the amount of the price paid as well as the amount of the delivery, if any, which is due to the wrong quantity or unavailable quantity of ordered products, the buyer paid for delivery, i.e. in the case when the subject of the return is the entire order, as well as to reimburse the cost of returning the product.

In case of return of one of the products purchased by the buyer, and the product was part of a special form of sale (e.g. 1 + 1 gratis), the buyer does not get back the full price of the product, but the price less the discount, or the price without special forms of sale. 

Changing the content of the page in any of its forms is prohibited, as well as copying, public display, etc. The use of the content of the site on other websites is prohibited.

Gigimigi is responsible for material defects of goods in accordance with the Code on Obligations, in case of complaints given within the legal deadlines.

In the event of a dispute between Gigimigi and the buyer, the buyer will seek out-of-court settlement of the dispute in accordance with the Consumer Protection Act. 

Gigimigi will accept the return of damaged, defective or incorrectly delivered goods at its own expense, if it is determined that the complaint is justified and that the buyer has not affected the correctness, damage or any defect of the goods.

The right to unilaterally terminate the Agreement

Only customers who are buyers have the right to unilaterally terminate the contract. The form for unilateral termination of the Agreement can be found here.

Unilateral termination

In order for the buyer to be able to unilaterally terminate the Agreement, he must inform Gigimigi of his decision to unilaterally terminate the Agreement before the deadline by an unequivocal statement sent by post (GIGIMIGI d.o.o., Remetnjak 12, Mavrinci, 51219 Čavle, Croatia) or e-mail info@gigimigi.eu, in which he states his name and surname, address, telephone number or e-mail address, IBAN to which he wishes to be refunded.

The form for unilateral termination of the Agreement can be filled in and sent electronically by the user / buyer, in which case Gigimigi will send him a confirmation by e-mail without delay of unilateral termination of the Agreement by e-mail.

The deadline for unilateral termination of the Contract is 14 (fourteen) days from the day when the buyer or a third party designated by the buyer, other than the carrier, the goods subject to the Contract are handed over, or in case of service, from the conclusion of the Contract.

 If you want to cancel your order after concluding the order and before delivery of the goods, please note the following:

  1. This form of order cancellation is only possible if you want to cancel the entire order. Individual order items cannot be supplemented or canceled.
  2. Customer-Guest: In order to cancel the entire order before shipping of the goods via contact form contact Gigimigi Customer Service. Due to automated order processing, the option to cancel an order only exists until a certain point of time. If your order can no longer be canceled, you still have the option of unilaterally terminating the contract after delivery of the goods.
  3. Customer with registered ‘My account’: You have the possibility to see the status of your order on your account. For orders that have not yet been sent, the status is "In progress". You will receive an order cancellation confirmation email upon successful cancellation requests. In the event that your order can no longer be cancelled, you still have the option of unilaterally terminating the contract after delivery of the goods.

If you wish to cancel your order after delivery of the goods, please note the following:

  1. Consumers have the right, without giving reasons, to unilaterally terminate the contract within fourteen (14) days of delivery. 
  2. In the case of a contract for the delivery of goods, the period begins on the day of delivery of the goods to you or a third party designated by you. In case of delivery in several shipments, the deadline starts with the receipt of the last shipment. A statement on the unilateral termination of the contract is given in a timely manner if it is sent within the specified deadline.
  3. Withdrawal from the purchase of more than one product delivered in combination at a flat rate is only possible in full in relation to that unit of product. In the event of a unilateral termination, this is a unilateral statement that we must receive. 
  4. In the event that we do not fulfill our information obligations in accordance with the Consumer Protection Act, the right to unilateral termination is extended to 12 months in relation to the above in the first paragraph. However, if we fulfill our obligations to inform within the specified period of 12 months, by submitting information on our part, the right to unilateral termination of the contract expires after (fourteen) 14 days from the receipt of the consumer's notice.

Consequences of unilateral termination

If the customer unilaterally terminates the Agreement, he will be refunded without delay, without delay, and no later than 14 (fourteen) days when Gigimigi at info@gigimigi.eu receives the user's decision to unilaterally terminate the Agreement. The refund will be made to the IBAN specified by the user in the form for unilateral termination of the Agreement. Gigimigi can only refund goods delivered to the customer after the goods have been returned to him or after proof has been provided that the goods have been sent back. Reimbursement of delivery costs is possible only after all goods delivered on the basis of the concluded Contract have been returned to Gigimigi. 

The Buyer is obliged to send the goods to the address GIGIMIGI d.o.o., Remetnjak 12, Mavrinci, 51219 Čavle, Croatia without undue delay, and in any case no later than 14 (fourteen) days from the day when he sent Gigimigi his decision to unilaterally terminate the Agreement. The direct costs of returning the goods are borne by the buyer. 

Prior to the termination of the Contract, the Buyer is requested to call the telephone number +385 91 984 5679 or contact info@gigimigi.eu in order to be explained the procedure for returning the goods. The received amount of the purchase price will be returned to the buyer to the account from which the payment was made or in the case of payment by cash on delivery or payment to the account submitted in writing to Gigimigi.

The buyer is responsible for any impairment of the goods resulting from the handling of the goods, other than that which was necessary to determine the nature, characteristics and functionality of the goods.

When returning the goods, the buyer is obliged to submit the accompanying documentation and the submitted warranty certificate that was attached to it, otherwise, Gigimigi is not obliged to return the paid price.

If, at the request of the user, the performance of the service started during the unilateral termination period, the buyer is obliged to pay Gigimigi an amount proportional to what was delivered by the time the user notified Gigimigi of the unilateral termination.

Exclusion of the right to unilateral termination of the contract

The buyer is not entitled to unilateral termination of the contract if:

  • the service is fully fulfilled, and the fulfillment began with the explicit prior consent of the buyer and with his confirmation that he is aware of the fact that he will lose the right to unilateral termination of the Contract if the service is fully fulfilled
  • is the subject of a Contract of goods which, by reason of their nature, are inseparably mixed with other things after delivery
  • entered into a contract for the delivery of goods that are made to the customer's specifications or are obviously tailored to the customer's personal needs
  • the goods due to their nature are not suitable for return or can spoil quickly
  • the goods have expired
  • it is a purchase referred to in Article 72 of the Consumer Protection Act, and in accordance with Article 79, item 4 and item 12 of the Consumer Protection Act.

Product evaluation

On our site, you have the opportunity to evaluate the displayed products. You can do this regardless of whether you bought the product through the Gigimigi online shop or in Gigimigi stores, or you may have come into possession of the product in some other way. Registration in the Gigimigi online shop is not required.

Gigimigi reserves the right to remove the feature of evaluating the displayed products at any time without prior notice.

Complaints / dispute resolution

In accordance with Art. 10 of the Consumer Protection Act, complaints related to product defects (with the indicated invoice number and attached photo of the product and description of defects) can be submitted to info@gigimigi.eu ili na adresu GIGIMIGI d.o.o., Remetnjak 12, Mavrinci, 51219 Čavle, Hrvatska.

In the event of a justified and timely complaint, the Buyer has the right to repair the purchased product, replace the product, proportionally reduce the price or may declare that it terminates the contract.

In each of these cases, the Buyer is also entitled to repair the damage according to the general rules on liability for damage, including damage suffered due to lack of product on other of his property.

The buyer is entitled to a price reduction only when the defect has not been remedied, if Gigimigi has refused to rectify the defect (except for the exemption under the Civil Obligations Act when Gigimigi is authorized to refuse to rectify the defect), if the defect exists although it was attempted to be rectified within a reasonable time or if the defect is such as to justify an immediate price reduction or termination of the contract. 

Gigimigi is entitled to refuse to remove the defect if repair and replacement are impossible or would cause disproportionate costs taking into account all circumstances, in particular the value of the defective product, the significance of the defect and the question of whether the repair can be performed without significant inconvenience to the customer.

The Buyer is authorized to terminate the contract if Gigimigi does not fulfill the consumer contract within a reasonable time.

If the defect is insignificant, the buyer has no right to terminate the contract, but he has other rights from liability for material defects, including the right to repair the damage.

If the buyer terminates the sales contract due to material defects of the product, the buyer returns the product to Gigimigi at Gigimigi's expense.

Gigimigi reimburses the customer for the price paid for the product after receiving the product or receiving proof from the customer that the product has been sent back.

The provisions of the Civil Obligations Act and the Consumer Protection Act apply in full to the rights and obligations of the customer regarding material defects. 

In case of damage and / or defect of the delivered goods, the buyer should send a photo of the complaint in order to accept it on the basis of physical evidence. 

The authorized person Gigimigi collects the complained damaged, defective or incorrectly delivered goods at the expense of Gigimigi if it is determined that the complaint is justified and that the buyer did not affect the defect, damage or any defect of the goods. In the event of a justified complaint, the cost of replacing the product with a new product or eliminating the defect is borne entirely by Gigimigi.  

In case of a dispute over the justification of the complaint and / or the manner in which the product was returned (the product must be unused, in unaltered quantity and in the original packaging, with the original invoice and warranty, if any), the product will be given to an expert witness or professional legal entity. 

If the complaint and the consequent expertise occurred before the expiration of one year from the date of delivery of the product to the customer, the cost of the expertise, regardless of the outcome, is borne by Gigimigi in full. In case the expert witness determines the justification of the complaint, all costs of replacement and expertise of the product are borne by Gigimigi, and in case of unjustified complaint sent after one year from the date of delivery of the product to the customer, the cost of expertise on the same complaint will be borne by the customer.

In the event of a justified complaint, the cost of replacing the product with a new product is borne entirely by Gigimigi. When repairing or replacing, the customer is obliged to make the item available to Gigimigi, and Gigimigi is obliged to take it over and bear the costs of taking over.

By special regulations of the European Union, from 15 February 2016, disputes related to online shopping can be resolved through a platform that you can access here. Therefore, in the event of difficulties or problems during online shopping within the EU, such as a defective product, inability to replace the product, etc., you can file a complaint through the above-stated link. The platform can be used by both consumers and traders, and complaints can be lodged in any of the EU's 23 official languages.

The European Commission provides a platform for out-of-court dispute resolution, i.e. it enables consumers from EU countries to resolve disputes related to their online orders without the involvement of courts. The Dispute Resolution Platform is available here: http://ec.europa.eu/odr

Gigimigi will not send the customer newsletters, i.e. electronic news notifications, etc. unless the customer has expressly agreed to it.

Other notes

Gigimigi reserves the right not to deliver the order if there is a suspicion of misuse and may also terminate the business relationship with any of its users at any time. Gigimigi reserves the right to immediately revoke any user passwords or user accounts in the event of any user behavior that Gigimigi deems unacceptable in its sole discretion, as well as in any case of non-compliance with these Terms.

Croatian law applies to the contractual relationship created by purchase through the Gigimigi online shop, and all disputes arising from the contractual relationship are subject to Croatian courts, excluding the United Nations Convention on Contracts for the International Sale of Goods and the rules governing applicable law. The language of the contract is Croatian. 

These Terms and Conditions enter into force on the day of publication on www.gigimigi.eu and are amended in accordance with the rules under which they were adopted.
